The Charleville International Half-Marathon: Terms of Entry
These terms and conditions (the "Terms")
will apply at all times to your entry and participation in the Charleville
International Half Marathon (the "Event") hosted by the committee of
North Cork AC.
Please read these Terms carefully and confirm to your
agreement as set out below before entering into and participating in the
Event.
It is the responsibility of the competitor to familiarise themselves
with the event rules and any Race Information as may be published on the
Charleville International Half-Marathon website www.CharlevilleHalf.com
Event Rules
- You must be in good health and physically prepared to complete
the half marathon Event.
- You must be at least 18 years old to participate in the half marathon
Event.
- You must be able to complete the half marathon Event in 2 hours and 20 mins or
less.
- Race numbers will be posted in advance of race day. It is critical you
enter your name and address correctly as we cannot be held responsible for
numbers not received as a result of an incorrect postal address entered on
registration form.
- Race numbers are required to be worn visibly on the front of your
t-shirt to participate.
- This is an AAI Permit event; therefore you must abide by
Athletics Ireland Rules and Regulations as set out on their website http://www.athleticsireland.ie/competition/rules-and-regulations/
Risks and liability
You acknowledge and agree that:
- you have trained and prepared appropriately for the Event, you are in
good physical condition, and you are fully aware of the risks and hazards
associated with taking part in the Event;
- you will assume all risks of losses, damages, illness or injuries that
may be sustained by you while participating in the Event and/or being
transported to and from the Event; and
- to the extent permitted by law we, any council, governmental body and
local authority agencies whose property and/or personnel are used in or in any
way assist the Event, all sponsoring or co-sponsoring companies or individuals
related to the Event, and all charities associated with the Event,
together with their officers, directors, shareholders, successors and assigns
(collectively, "Releases") shall have no liability to you for any
form of direct loss, indirect or consequential loss, damages, costs or claims
of any kind arising from: (i) your participation in the Event; (ii) your travel
to and from the Event; or (iii) any personal property you take to, or use in
connection with, the Event.
Please note that nothing in these Terms will exclude or limit
any liability of any Release (as defined above) for: (i) death, illness or
personal injury caused by that Release's negligence; or (ii) any other
liability which cannot be excluded or limited by law. The Releases
advise you to be insured for any personal injury arising from your
participation in the event.
Refunds, Transfers
and Cancellations
You agree that for the 2020 Charleville International Half-Marathon, entries
are only refundable until August 13th 2020 (excluding the processing
fees) and after this date, it will only be possible to transfer your entry to
another participant until entries are closed and postage of entries need to
occur.
You acknowledge that we may need to delay or cancel the Event if we
consider this is necessary, including if we believe the conditions on
the day of the Event are unsafe. Entry fee’s (excluding processing fee’s)
shall be refunded if the event is cancelled prior to August 13th.
If the Event is delayed or cancelled or if you withdraw for any reason:
- we will not provide any refund of your entry fee after the 13th
of August; and
- we shall have no liability for any costs, expenses or losses of any
kind incurred by you in connection with the Event including without limitation
your accommodation and travel to the Event.
Medical Attention at
the Event
You acknowledge and agree that:
- the medical staff we appoint at the Event may provide you with any
medical care and advice you require at the Event;
- you have the right to refuse medical care and advice of the Event
medical staff; and;
- your personal data which constitutes medical information (being
information as to your physical or mental health or condition) may need to be
used by us or our medical staff solely in order to provide you with medical
care and advice at the Event. We shall process any such personal data at
all times in accordance with the Data Protection Act 1998
Use of your name
and image
You agree that we may store and use your name and/or image in
broadcasts, newspapers, brochures and other media (including in advertising or
sales promotional materials and in competitor listings and results) in
connection with the Event or future events hosted by us without any payment of
any kind to you in connection with such use.
The Jurisdiction
These Terms and Conditions shall be governed by
Irish law and you agree that all disputes arising out of or relating to
these Terms and Conditions shall be submitted to the
exclusive jurisdiction of the courts of Ireland.
Your Agreement to
these Terms
You confirm that you have read and agree to these Terms, that the
statements made about you in these Terms are true and accurate, and
that we have relied on these statements in allowing you to participate in the
Event.
